Terms of Service

1. Acceptance of terms
By accessing or using the SendLib website (sendlib.com) or the SendLib email delivery platform (“Service”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
2. Description of service
SendLib provides an email delivery infrastructure platform, including API and SMTP relay services, delivery analytics, and deliverability consultancy. Service features and availability may vary by plan.
3. Account responsibilities
- You are responsible for maintaining the confidentiality of your API keys and account credentials.
- You are responsible for all activity that occurs under your account.
- You must provide accurate and complete information when registering.
- You must notify us immediately of any unauthorized use of your account.
4. Acceptable use
You agree not to use the Service to:
- Send unsolicited bulk email (spam) or messages that violate CAN-SPAM, GDPR, or other applicable laws
- Transmit malware, phishing, or fraudulent content
- Impersonate any person or entity
- Interfere with or disrupt the integrity or performance of the Service
- Attempt to gain unauthorized access to the Service or related systems
- Use the Service for any illegal purpose
We reserve the right to suspend or terminate accounts that violate these policies.
5. Sending requirements
- You must own or have authorization to send from the domains you configure.
- You must properly configure SPF and DKIM authentication for your sending domains.
- You must honor unsubscribe requests and maintain appropriate suppression lists.
- You must comply with all applicable email regulations in your jurisdiction.
6. Pricing and payment
Pricing is determined on a custom basis as agreed between you and SendLib. Payment terms, billing frequency, and volume commitments are specified in your individual service agreement. We reserve the right to modify pricing with reasonable notice.
7. Service availability
We strive to maintain high availability of the Service but do not guarantee uninterrupted access. Scheduled maintenance will be communicated in advance when possible. Service level commitments, if applicable, are defined in your service agreement.
8. Intellectual property
The Service, including its design, features, and documentation, is owned by SendLib and protected by intellectual property laws. You retain ownership of your content and data. You grant us a limited license to process your data solely to provide the Service.
9. Limitation of liability
To the maximum extent permitted by law, SendLib shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service.
10. Termination
Either party may terminate the service relationship with written notice as specified in your service agreement. We may suspend or terminate your access immediately if you violate these terms. Upon termination, your right to use the Service ceases and we may delete your data after a reasonable retention period.
11. Changes to terms
We may update these Terms from time to time. Material changes will be communicated via email or through the Service. Continued use after changes constitutes acceptance of the updated terms.
